Terms of Use

These Terms govern your use of the BodyTracker iOS app and related services.

BodyTracker is not a medical device or medical service. It does not provide medical advice, diagnosis, treatment, or emergency assistance. Do not rely on it to make medical decisions. Consult a qualified healthcare professional about health concerns and contact local emergency services in an emergency.

1. Provider and agreement

BodyTracker is provided by Igor Korolev ("BodyTracker," "we," "us," or "our"). Contact: support@bodytracker.app. By downloading, purchasing, or using BodyTracker, you agree to these Terms and our Privacy Policy.

Your license to the app is also governed by Apple’s Standard End User License Agreement ("Apple EULA"). These Terms supplement the Apple EULA. If they conflict on licensing terms, the Apple EULA controls.

2. Eligibility

You must be at least 16 years old to use BodyTracker. You must also be legally able to enter this agreement under the laws that apply to you. If you do not meet these requirements, do not use the app.

3. The service

BodyTracker lets you record and compare progress photos, measurements, weight, and related goals. Some functions depend on your device, Apple Health, iCloud, the App Store, network connectivity, permissions, and third-party services. We may add, change, suspend, or discontinue features when reasonably necessary to maintain, secure, improve, or comply with law, while respecting any mandatory consumer rights.

4. Your content and responsibilities

You retain ownership of photos, measurements, feedback, and other content you create. You give BodyTracker only the limited permission necessary to process that content on your device, in your private iCloud storage, or through the feedback service as you direct.

You are responsible for the accuracy and suitability of information you enter, for maintaining access to your Apple ID and device, for appropriate backups or exports, and for obtaining any necessary permission before adding content involving another person.

5. Acceptable use

You must not misuse BodyTracker, interfere with its operation or security, attempt unauthorized access, reverse engineer the app except where applicable law expressly permits it, use it to violate another person’s privacy or intellectual-property rights, submit unlawful or harmful material, or use automated means to overload related services.

6. Purchases

Paid features are offered as one-time in-app purchases unless the App Store product page clearly states otherwise. Apple processes payments, refunds, taxes, billing issues, purchase history, and purchase restoration under its terms. Available features and prices are displayed before purchase. Statutory refund or cancellation rights remain unaffected where they cannot lawfully be excluded.

7. Health and safety

Measurements, charts, comparisons, estimates, reminders, trends, and goals are informational tools. They may be incomplete, delayed, inaccurate, or affected by device, input, lighting, pose, unit, or third-party data. BodyTracker does not monitor you and cannot detect or respond to a medical emergency. You remain responsible for decisions and actions concerning your health.

8. Privacy and data deletion

Our Privacy Policy describes information handling. The in-app erase action and its limits are described in the Data Erasure Guide. Deletion is irreversible and may require the same iCloud account previously used for synchronization.

9. Intellectual property

BodyTracker, its software, design, text, graphics, and trademarks are owned by us or our licensors and are protected by applicable law. Except for the limited license granted under the Apple EULA, no rights are transferred to you. Third-party software remains subject to its applicable notices and licenses.

10. Third-party services

Apple services, analytics and diagnostic providers, and network or hosting services are operated by third parties under their own terms. We are not responsible for third-party services outside our control, but we remain responsible for our own obligations under applicable law.

11. Availability, updates, and termination

You may stop using BodyTracker at any time. We may restrict or terminate access if you materially violate these Terms, misuse the service, or create a security or legal risk. We may require updates for compatibility, security, or legal reasons. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and governing law—will survive.

12. Disclaimers

To the maximum extent permitted by law, BodyTracker is provided "as is" and "as available." We do not promise uninterrupted or error-free operation, permanent availability, or that the app will meet every individual purpose. Nothing in these Terms excludes warranties or remedies that applicable consumer law does not allow us to exclude.

13. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, loss of opportunity or data, or harm caused by reliance on BodyTracker as medical advice. Our aggregate liability arising from the app will not exceed the greater of the amount you paid for BodyTracker in the 12 months before the event giving rise to the claim or the minimum amount required by applicable law. These limits do not apply where liability cannot lawfully be limited, including for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

14. Governing law and disputes

These Terms are governed by the laws of Spain, without regard to conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections available under the law of your habitual residence, and you may use any courts or dispute-resolution mechanisms available to you under mandatory law. Before starting a formal dispute, please contact us so we can try to resolve it.

15. Changes to these Terms

We may update these Terms for legal, security, operational, or product reasons. The current version and effective date will be posted here. If a change materially affects your rights, we will provide reasonable additional notice. Continued use after the effective date constitutes acceptance where permitted by law.
